Regulations of the decorative accessories rental “Decoria Studio”

(“Regulations”)

§1
Introductory provisions

The decorative accessories rental „Decoria Studio” available at https://flowersdecor.com.pl//en/rental/ (next „Rental”) is leaded by Patrycja Tachmańska, who leads a business called Decoria Studio Patrycja Tachmańska, ul. Stanisława Dubois 12 lok. 30B, 00-188 Warszawa, NIP: 8241754874 (next “Decoria Studio“).

These Regulations are addressed to both Consumers and Entrepreneurs using the Rental and define the rules of using the Rental and the rules and procedure for concluding contracts with the Customer at a distance through the Rental.

§2
Definitions
  • Consumer – a natural person concluding a Lease Agreement with Decoria Studio as part of the Rental, the subject is not directly related to its business or professional activity.
  • Decoria Studio – Landlord, ie Patrycja Tachmańska leaded a business called Decoria Studio Patrycja Tachmańska, ul. Stanisława Dubois 12 loc. 30B, 00-188 Warszawa, NIP: 8241754874, leaded the Rental.
  • Customer – any entity ordering Products through the Rental.
  • Entrepreneur – a natural person, a legal person and an organizational unit that is not a legal person, that the separate law admits legal capacity, using a business activity on her behalf, that uses the Rental.
  • Rental – an online shop leaded by Decoria Studio at the Internet address https://flowersdecor.com.pl//en/rental/ depending on the rental of Products constituting decorative accessories for various circumstances organized by the Customer Borrowed Products are returnable.
  • Distance contract – Lease agreement concluded with the Customer as part of an organized system of concluding distance contracts (as part of the Rental), without the simultaneous physical presence of the parties, with only use of the one or more means of distance communication until the conclusion of the Agreement, inclusive.
  • Regulations – these Rental regulations.
  • Order – the Customer’s statement folded with the Order Form and headed directly to the conclusion of the Product Lease Agreement or Products with Decoria Studio.
  • Account – Customer’s account in the Rental, it contains data provided by the Customer and information about Orders placed by him in the Rental.
  • Registration form – a form available in the Rental, enabling the creation of an Account.
  • Order form – an interactive form available in the Rental that allows placing an Order, in particular by adding Products to the Cart and specification of conditions of the Sales Agreement, including the method of delivery and payment.
  • Cart – an element of the Rental’s software in which the Products selected by the Customer are visible for rent, and it is also possible to determine and modify the Order data, in particular the quantity of Products.
  • Product – a movable item available in the Rental (decorative accessories rental) which is the subject of the Lease Agreement between the Customer and Decoria Studio.
  • Deposit – a fee paid when placing an Order in the amount of 50% of the Order value, refundable in full after returning the Products, if the rented Products are returned intact and after cleaning (unless the Customer additionally paid for cleaning the Products by Decoria Studio).

Lease Agreement – a contract for the rent of the Product (s) concluded between the Customer and Decoria Studio through the Rental.

  7. The customer may communicate with Decoria Studio using the addresses and telephone numbers provided in this paragraph.
  8. The client may communicate by phone with Decoria Studio on working days between 9:00 am and 5:00 pm, Monday to Friday.
§4
Technical requirements

To use the Rental, including viewing the Rental’s assortment and placing Orders for Products, are necessary:

  1. terminal device with access to the Internet and a web browser;
  2. an active e-mail account (e-mail);
  3. cookies enabled.
§5
General information

Decoria Studio, to the fullest extent permitted by law, is not responsible for any disruptions, including interruptions in the functioning of the Rental, caused by force majeure, unlawful actions of third parties or the Rental’s incompatibility with the Customer’s technical infrastructure.

Viewing the Rental’s assortment does not require creating an Account. Placing Orders by the Customer for Products in the Rental’s assortment is possible while placing the Order or through the Registration Form according to the provisions of § 6 of the Regulations.

The prices given in the Rental are given in Polish zlotys and are gross prices (including VAT).

§6
Creating an Account in the Rental

To create an Account in the Rental, complete the Registration Form. It is necessary to provide the following data:

  1. name and surname or company name;
  2. address for delivery;
  3. telephone number;
  4. e-mail address;
  5. NIP (in the case of Entrepreneurs).

Creating an Account in the Rental is free.

Logging in to the Account is done by entering the login and password set in the Registration Form.

The Customer has possibility at any time, without giving a reason and without incurring any fees, remove the Account by sending an appropriate request to Decoria Studio, in particular through e-mail or in writing to the addresses provided in § 3.

Rules for placing the Order

In order to place the Order you must:

  1. log in to the Account in the Shop or go to point b) and place an Order without registration;
  2. select the Product that is the subject of the Order, the number of pieces, provide the date of the celebration to which the Order relates, no later than 14 days from placing the Order, and indicate whether the Product will be returned without cleaning, which involves an additional fee, and then click the “Add to basket” button;
  3. if you have chosen to place an Order without registration or have not previously created an Account – after clicking the “Go to payment” button, complete the Order Form by entering: customer data, customer’s address, choose the method of delivery of the Product – courier or personal pick-up, enter the shipping address, if it is different from the customer’s address;
  4. click the “Borrow and pay” button, a returnable Deposit of 50% of the value of the Order will be added to the value of the order. The minimum order value is PLN 200;

choose one of the available payment methods and pay for the order within 3 calendar days at the latest.

§8
Delivery, payment and Deposit return methods offered

The Customer may use the following methods of delivery or receipt of the ordered Product:

  1. Courier shipment payable PLN 25 for orders below PLN 1000, above this amount the shipment is free;
  2. Personal pickup available at the address of the Decoria Studio warehouse: ul. Wiejska 4, 07-104 Stoczek.

The customer can use the following payment methods:

  1. Payment by bank transfer to the Decoria Studio account.

The deposit will be returned within 7 days from the date of return of the rented Products. In the event of damage to or destruction of the Products or no cleaning them, despite not selecting this option, the deposit will be reduced by the cost of repair / replacement or cleaning of the Product.

§9
Performance of the Lease Agreement

The conclusion of a Lease Agreement between the Customer and Decoria Studio takes place after the Customer has placed an Order using the Order Form in the Rental according to § 7 of the Regulations.

After placing the Order, Decoria Studio immediately confirms its receipt. Decoria Studio checks whether selected elements are available for a given date of the ceremony. If the selected items are available, Decoria Studio accepts the Order for realization. Confirmation of receipt of the Order, confirmation of the availability of the Order and its acceptance for realization takes place by sending by Decoria Studio to the Customer an appropriate e-mails to the Customer’s e-mail address provided when placing the Order, which contain at least Decoria Studio’s statements about the receipt of the Order, statements about the availability of the Order and its acceptance for realization and confirmation of the conclusion of the Lease Agreement. With the moment the receipt of the above e-mails by the Customer, the Lease Agreement is concluded between the Customer and Decoria Studio.

The Customer is obliged to make the payment within 3 calendar days from the date of the Lease Agreement – otherwise the Order will be canceled.

If the Customer has chosen a delivery method other than pickup in person, the Product will be delivered by Decoria Studio 1-3 days before the date of the ceremony, indicated by the Customer when placing the Order.

If the Customer chooses to pickup the Products in person, the Products will be ready for return by the Customer within 1-3 days before the date of the ceremony, indicated by the Customer when placing the Order. The Customer will be additionally informed about the readiness of the Products for return by Decoria Studio by sending an appropriate e-mail to the Customer’s e-mail address provided when placing the Order.

Products are delivered only in Poland.

After using the Products, the Customer may send them back to the Decoria Studio warehouse address indicated in §3 of the Regulations by courier shipment or return the Product in person. The returned Products should be returned within the first business day after the end of the ceremony.

§10
The right of withdraw from the Agreement

According to Art. 38 point 1 of the Act of 30 May 2014 on consumer rights, the right to withdraw from an Agreement concluded outside the business premises or at a distance is not available to the consumer in relation to contracts for the provision of services, if the entrepreneur has fully made the service with the express consent of the consumer who has been informed before the commencement of the service, that after fulfillment of the service by the entrepreneur, he will lose the right to withdraw from the contract.

By concluding an Agreement with Decoria Studio, the Customer who is a Consumer agrees to the commencement of the fullfilment of the service by Decoria Studio and receives information that after the delivery of the Order, he loses the right to withdraw from the Agreement.

Until the Agreement is performed by Decoria Studio, the Consumer may withdraw from the Rental Agreement within 14 days without giving any reason under the conditions set out below.

The running of specified deadline in sec. 3 begins with the conclusion of the Lease Agreement.

The consumer may withdraw from the Agreement by submitting Decoria Studio a declaration of withdrawal from the Agreement. To meet the deadline for withdrawal from the Agreement, it is enough for the Consumer to send a statement before the expiry of this period.

The statement may be sent by traditional mail or by e-mail to the Decoria Studio e-mail address specified in § 3 of the Regulations. The statement may also be submitted on the form, the formula of which is attached to the Act of May 30, 2014 on consumer rights, but it is not obligatory.

If the Consumer sends the declaration by e-mail, Decoria Studio immediately send the Consumer to the e-mail address provided by the Consumer delivery confirmation of the statement of withdrawal from the Agreement.

Consequences of withdrawal from the Agreement:

  1. In the case of withdrawal from a Distance Agreement, the Agreement is not included.
  2. In the case of withdrawal from the Agreement, Decoria Studio returns to the Consumer immediately, not later than within 14 days from the date of receipt of the Consumer’s statement on withdrawal from the Agreement, all payments made by him, including the costs of delivering the goods, with exception additional costs resulting from the chosen by the Consumer of a delivery method other than the cheapest standard delivery method offered by Decoria Studio.
  3. The return will be made by Decoria Studio using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution that will not involve any costs for him.
§11
Complaint

The Lease Agreement covers new and used Products.

Decoria Studio is obliged to provide the Client with an item free from defects.

In case of a defect in the goods ordered from Decoria Studio, the Customer has the right to make a complaint based on the provisions of the Civil Code regarding the warranty for defects in the rented goods.

Complaints should be submitted in writing or by e-mail to the Decoria Studio addresses provided in these Regulations. The complaint should include:

  1. name and surname of the advertiser;
  2. e-mail address for correspondence (if it is a different address than the e-mail address from which the complaint was sent);
  3. description of the reason for submitting the complaint;
  4. advertiser’s request.

Decoria Studio will respond to the complaint immediately, and if the Customer is a Consumer – no later than within 14 days. If the Customer is a Consumer and Decoria Studio does not respond to the complaint within 14 days, it is considered that the Customer’s request was considered justified.

Products sent as part of the complaint procedure should be sent to the address of the Shop’s warehouse given in § 3 of these Regulations.

Decoria Studio agrees to out-of-court complaint handling. Detailed information relating the possibility to use out-of-court complaints handling for the Consumer and redress and the rules of access to these procedures are available at the offices and on the websites of district (urban) consumer advocates, social organizations whose statutory tasks include consumer protection, Voivodeship Inspectorates of Trade Inspection and on the website of the Office of Competition and Consumer Protection.

§12
Personal data

The administrator of personal data of Customers who are natural persons, collected through the Rental, is Decoria Studio.

Customer’s personal data collected by the Administrator through the Rental are collected in order to implement the Lease Agreement, and if the Customer agrees – also for marketing purposes.

The recipients of the personal data of the Rental’s customers may be:

  1. In the case of a Customer who uses the method of delivery in the Rental by courier, the Administrator provides the Customer’s collected personal data to the selected carrier or intermediary performing the shipment at the request of the Administrator.

§13
Final resolutions

Agreements concluded through the Rental are concluded in Polish or English.

Decoria Studio reserves the right to make changes Regulations with important reasons, that is: changes in the law, changes in payment and delivery methods – to the extent to which these changes affect the implementation of the provisions of these Regulations. Decoria Studio will inform the customer about each change at least 7 days in advance.

In matters not covered by these Regulations have application generally applicable provisions of Polish law, in particular: the Civil Code, the Act on the provision of electronic services, the Act on consumer rights.
